New Biden gun rule will BAN private firearms sales, ATF whistleblowers warn

The rumor mill is speculating that the Biden regime is about to ban all private gun sales in America, meaning gun enthusiasts would need to make all their purchases through only licensed vendors. The watchdog group Empower Oversight says the Biden regime needs to procure documents showing what this alleged regulation entails. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is said to be spearheading the rule, which will also require universal background checks on most or all gun sales period. Back in August, President Biden rallied his troops around the proposition of stricter gun laws in the United States. Biden said he wants people who "repetitively" sell firearms to register as federally licensed gun dealers, which would make them subject to background checks. According to Empower Oversight, whistleblowers within ATF told the watchdog group that, at the direction of the Biden White House, the federal agency "has drafted a 1,300-page document to justify a rule effectively banning the private sale of firearms," this according to a series of X posts by Empower Oversight president Tristan Leavitt. "The whistleblowers say the rule is being drafted by Senior Policy Counsel Eric Epstein, who worked as the Phoenix Field Office's Division Counsel during Operation Wide Receiver (a precursor of Operation Fast and Furious)," Leavitt wrote in one of the posts. "Such a sweeping rule with the effect of banning private sales would clearly violate the Second Amendment to the United States Constitution, which declares that 'the right of the people to keep and bear Arms, shall not be infringed.'" To get to the bottom of the matter, Empower Oversight filed a Freedom of Information Act (FOIA) request with both the Department of Justice (DoJ) and ATF seeking additional information about what Biden has planned. This includes a request for all communications with the White House, as well as any potential Jeffrey Epstein emails addressing the alleged plan. It would be a pretty bad year for Biden to unveil such a measure, seeing as how we have now entered another rocky presidential election cycle. Biden making headlines for taking people's guns might not go over so well with the general electorate, though time will tell. In 2022, the ATF already interpreted a bipartisan gun law to mean that more people must register as federally licensed gun dealers in order to continue selling them legally. The law was passed after the mass shooting in Uvalde, Tex., and was aimed at people who repetitively sell guns "to predominantly earn a profit." Before Uvalde, the law only applied to gun sellers who had "the principal objective of livelihood and profit," meaning only people whose gun sales are a primary source of their living income. Concerning the new alleged law, private gun sellers would need to perform all of the usual duties as gun dealers, including conducting background checks by entering gun buyer information into the FBI's National Instant Criminal Background Check System (NICS). Since the proposition is still just a rumor, its precise wording remains unknown. The ATF whistleblower who brought it to light says that this is the gist of it, which is why they are concerned. Many private gun sellers might not be able to easily access NICS, or they may not even know that they need to, putting them in legal jeopardy. As for family gun transfers and other ways guns move around to different hands, there is no indication what would become of all this under the new proposal, though we do know that if real, it would have to first undergo a public notice and comment period during which the American public would have a say in its passage or rejection.
