Bailey, 6 other AGs sue Biden's HHS for forcing healthcare providers to perform genital mutilations
Missouri Attorney General Andrew Bailey and six other state attorneys general are set to file a lawsuit against President Joe Biden's order to
withhold federal funds from healthcare providers who choose not to perform gender alteration procedures.
In May, the
Department of Health and Human Services (HHS) finalized a rule that defined
"sex" as encompassing "gender identity" in federal health law. This means that refusal to provide what the government coined as "gender-affirming care" to those who identify as other than their actual sex is discriminatory. If state healthcare services and plans fail to comply with the set rule, their access to federally funded programs like Medicare, Medicaid and the Children's Health Insurance Program (CHIP) could be cut off.
The said measure was supposed to go into effect on July 5, but a Mississippi federal judge issued a preliminary injunction in a lawsuit filed by 15 Republican states against it. Missouri's new lawsuit is another
attempt to block the rule.
"HHS threatens to punish doctors and States who do not comply with the mandate by imposing huge financial penalties and excluding them from federally funded healthcare programs," the lawsuit indicated. "This punishment would effectively preclude doctors and States from providing healthcare for the most vulnerable children in low-income communities."
According to the
Catholic News Agency, AGs from Arkansas, Idaho, Iowa, North Dakota, South Dakota and Utah will also join in filing the case, as well as the American College of Pediatricians (ACPeds).
"Joe Biden is once again exceeding his legal authority to
force his radical transgender ideology onto the American people," said Bailey, who is leading the charge. "I am filing suit because I will not allow out-of-touch federal bureaucrats to force Missouri health care providers into performing experimental and dangerous gender-transition procedures on the taxpayer dime."
The plaintiffs of the new lawsuit contend that the HHS is illegal on multiple grounds, including violating physicians' rights, overriding state authority and rulemaking without statutory authority.
ACPeds Executive Director Dr. Jill Simons added that doctors should never be forced to violate their sound medical judgment and perform life-altering and sterilizing interventions on their patients. She emphasized that doctors take an oath not to harm, "but the Biden administration's rule forces them to violate this oath and perform procedures that are harmful and dangerous to our patients – vulnerable children. What the Biden administration is calling for is wrong and unlawful."
Meanwhile, the Human Rights Campaign has blasted previous attempts to prevent this rule from being implemented, with the HHS saying that the rule's updated definition of sex discrimination is in line with a 2020 Supreme Court decision protecting employees from discrimination based on sexual orientation and gender identity.
The AGs and other analysts believe that the Biden administration should not easily give in to the left cult and LGBTQ ideologies because studies have found that 80 percent of the youth with gender dysphoria outgrow it by late adolescence. Also, full "reassignment" surgery often fails to resolve gender-confused individuals' heightened tendency to engage in self-harm and suicide. (Related:

Doctors who perform the mutilations have also admitted to more old-fashioned motives for such procedures, as with a 2022 expose about
Vanderbilt University Medical Center's Clinic for Transgender Health, where Dr. Shayne Sebold Taylor said outright that "these surgeries make a lot of money."
Biden now opposes transgender surgeries for minors
A few months before the election, Biden declared his opposition to
gender alteration surgeries on minors – a strong statement that contradicts his previous stand on transgender procedures being a staunch supporter of LGBTQIA rights. The Biden administration's previous statements on this topic have not in the past explicitly opposed surgery.
Analysts argue that this move is another way to deviate attention from the president's recent gaffes and blunders that have raised concern among his fellow Democrats, calling him to step aside for a younger party candidate. Also, medical care for transgender adolescents has become a hot-button issue in many states and the POTUS may have been trying to win voters from conservative political circles.
Meanwhile, Biden's announcement came on the heels of transgender HHS Assistant Secretary Rachel Levine's staff urging an influential international transgender health organization to
remove age minimums for surgery from its treatment guidelines for minors. The draft guidelines would have lowered the age minimum to 14 for hormonal treatments, 15 for mastectomies, 16 for breast augmentation or facial surgeries and 17 for genital surgeries or hysterectomies. The final guidelines, released in 2022, removed the age-based recommendations altogether.
"Adm. Levine shared her view with her staff that publishing the proposed lower ages for gender transition surgeries was not supported by science or research and could lead to an onslaught of attacks on the transgender community," an HHS spokesman said in a statement.
The administration, which has been supportive of gender-affirming care for transgender youth, expressed opposition only to surgeries for minors, not other treatments. The procedures are usually irreversible, critics have said.
